Speech Bubble Creative™ also referred to as SBC.
Office hours
- SBC is open on weekdays only, from 8am to 5pm.
General
- All the conditions apply to design, printing, website and internet as well as any other services offered by SBC, and visa versa.
- Retainers are non-refundable.
- All content is assumed to be approved by the client in any media.
- SBC provides no guarantees or warrantees whatsoever.
- SBC is a design company and does not offer any technical support.
- Work in progress will be billed for every 2 weeks according to the amount that has been completed, this is COD and COD terms apply.
- All work remains the property of SBC until paid for in full; this also means that invoices that contain multiple items must be paid in full before any item is the property of the client.
- Interest of 10% will automatically be charged on all COD work not paid for within 7 days.
- SBC reserves the right to change these terms and conditions without prior notice.
INCIDENTAL INTEREST
Incidental interest are charges becoming due only if you fail to pay for the goods and services after a certain period of time, usually 30 days.
In terms of regulation 42(1) (contained in GN R489 of GG 28864 of 31 May 2006), the maximum prescribed rate of interest is capped at 2.00% (Two Per Centum) per month, calculated daily and added to the deferred amount monthly.
The interest charged to the consumer would be capped in terms of regulation 42(1) at 2.00% per month (i.e. at 24.00% per annum). In terms of the section 5(2) deeming provision, the incidental credit agreement would only be formed twenty days after the service provider first charges interest.
To avoid Incidental Interest please settle accounts promptly.
Estimates
- Quotes are only valid for 14 days from the date on the quote.
- Please note: estimates are based on the stated outcomes – changes to the brief will result in changes to total cost.
Deposits
Design Projects
- A 50% deposit is required before starting the project.
- Once the project has started the deposit is non-refundable.
- Final payment is required with the completion of this project.
- Any printing or ordering of promotional items and/or gear will require a 100% deposit on those items.
Printing projects & branded orders
- A 100% deposit is required before printing or ordering the branded goods.
- Once the project has started the deposit is non-refundable.
- Final payment is required with the completion of this project.
- Any printing or ordering of promotional items and/or gear will require a 100% deposit on those items.
Design & changes
- SBC will charge you for design time, regardless whether or not you go through with printing the final product or not.
- Changes to the design brief will result in changes to total cost.
- Changes deemed by SBC as fair and reasonable will be done at no charge, if it was in the scope of the project and does not require major changes or redesign (e.g. spelling mistakes, small formatting changes like line spacing or headed changes.
- Changes on designs will be limited to 3 major changes – thereafter clients may be charged the hourly rate for additional changes.
Printing, embroidery and promotional items
- Colours may vary from proofs and samples and computer screens.
- Digital proofs colours and quality may vary from litho printing.
- Printing time may vary.
- All content is assumed to be approved by the client, including all colours, content, errors & omissions.
- SBC will not be responsible for any mistakes made in proofing, the client is 100% responsible.
- If mistakes have been proofed and printed, then SBC may consider re-doing the job at a reduced price.
- All artwork that is printed is considered a sample until it has been signed and dated by the client, thereafter it is considered a proof.
- Proofs are to be signed and dated before printing begins.
- Promotional items that have been specifically branded can unfortunately not be refunded
- Proofs can be done via digital printed proof, email or fax, however colours will vary from proof to print and colours can’t be proofed by fax or email.
- SBC will not be held responsible for any damages that may result in late delivery of any product.
- All goods are to be returned within 5 working days if there is an issue.
- If a mistake is noticed before printing begins and needs to be corrected then the client will be responsible for all costs in altering that artwork. For example: printing plates have been made, but the job has not been run yet.
Branding
- No branding will commence unless artwork has been signed off and approved by the customer.
- No branding will commence unless the complete order has been paid for in full for COD customers.
- Production will only commence the day after payment has been received.
- Once final artwork is approved the order cannot be cancelled.
- Completion of branding may take between 3 – 10 days from the date the artwork has been approved in the correct format and payment has been made.
- Lead times may vary depending on volumes, complexity of branding required and production capacity in the operation.
- The type of branding available may be limited by the item chosen, and certain branding applications are only possible on particular items.
- No branded items will be accepted for return unless defective.
Colour Disclaimer
Great care is taken to match colours as accurately as possible. Please note however that as full colour work involves the grouping of like print jobs together marginal colour variations are to be expected. These marginal variations will occur from one print run to another.
A 100% exact colour match is not possible. The most accurate means of colour matching entails printing the job in isolation as a standalone job. However this means of printing is not always possible as this will result in the print cost of the job being significantly greater.
The grouping together of full colour work allows for economies of scale which results in a lesser end cost to the client and a quicker turnaround of the printed matter.
Complaints about colour?
If you are not happy with your job, lodge your claim via our after sales support. Alternatively you can send us 100 – 200 samples of your print job so we can find out what went wrong. If we deem the problem a manufacturing defect, we will be more than happy to reprint your job. However SBC will not be responsible for design flaws, including but not limited to, typos, resolution issue / not enough bleed for cutting. SBC has the right to decide what is and what is not a manufacturing defect.
Web design & Hosting
- All content is to be supplied within 1 month of the deposit being paid. Any extensions will need to be done so in writing.
- SBC is not responsible for the maintenance/renewals of domains.
- SBC does not do hosting, nor does it have any control over the status of your website or email.
- Any problems with technical aspects of websites are to be taken up with your service provider.
- In the case where the client has no hosting service, SBC will recommend one, however the client understands that the agreement is between them and the service provider.
- SBC will not be held responsible for any sites or email that is/are temporarily unavailable.
- SBC is not responsible for backing up of website, hosting solutions or email.
- SBC is not responsible for transferring domains or setting up your email, however we may choose to do so for an additional cost.
- In order for SBC to upload your website, you will be required to provide the FTP details.
- Websites are built to be compatible in the latest browser versions only.
- SBC will not be held responsible for any damages resulting from websites being down, unavailable, infected by viruses, deleted or any other reason.
- SBC cannot determine the size of space your website will require or the traffic that you may use.
- Any content changes to new websites, must be done within one week of the site going live.
- SBC is not responsible for any damages resulted from the removal of work or websites not paid for.
- SBC is also not responsible for your dialup connection or any other connectivity.
- It is the client’s responsibility to supply all content for any web maintenance or monthly packages.
- Quotes on websites do not include website registration with search engines or site optimization, but meta tags will be included on your submission (meta tags are the words that you think people will type in search engines in order to find You. e.g. SBC may be found if someone types ”design services”
Filming & Photography
- SBC is not responsible for any malfunctioning equipment, or any damages that may result in our equipment not working on any day of filming, photography or any other media.
- SBC may require two weeks’ notice prior to arranging a date for filming or photography.
- SBC is not responsible for any media not playing across different platforms and computers.
Copyright
- Under no circumstances will SBC or any employees be held responsible for any copyright disputes.
- Any right that may be required for any of the content is not the responsibility of SBC.
- It is the responsibility of the client/associate to gain whatever permissions/rights may be necessary for all work done by SBC prior to use that may require so. This includes any footage, pictures, songs and other content, provided by SBC Or by the client/associate. This is also the case if SBC is featured for gain in the final product.
- Any content provided by the client or SBC that is later discovered needs the proper rights to use will be the responsibility of the client and if changes have to be made will be charged accordingly.
- SBC will not be held responsible for any licensing disputes regarding the photography and stock images available on our websites. If you would like to use them then you need to get the necessary permissions.
Marketing
- As a SBC Client you agree to receive Marketing and Advertising form time to time. You may however elect to opt out at a later stage by sending an e-mail to info@speechbubblecreative.co.za stating your intention to opt out and request to be removed from the list.
SBC reserves the right to alter the terms and condition without prior notice and to their discretion at any time.
